Rental Income Tax in Israel: 10% Track vs Marginal Track vs Exemption

    Israel taxes rental income three different ways. Most landlords pick the wrong one and overpay every year.

    Three regimes compete for any Israeli residential rental:

    1. Exemption track — rent below the monthly threshold (~NIS 5,654 in 2026) is tax-free with no return required.
    2. 10% flat track — flat 10% on gross rent, no deductions, simple filing.
    3. Marginal track — net rental income (gross minus expenses and depreciation) taxed at your marginal rate.

    The exemption ceiling

    The NIS 5,654 monthly figure is per landlord, not per property. Two apartments rented for NIS 4,000 each (NIS 8,000 total) are above the exemption ceiling. A partial exemption phase-out applies up to roughly NIS 11,300/month, after which full marginal taxation kicks in on the entire rent.

    10% track: when it wins

    • Older property, no mortgage, low maintenance — most rent flows to taxable income.
    • You don't want to track expenses or depreciation.
    • Foreign owners who want simple compliance.

    Marginal track: when it wins

    • Newly purchased property with a large mortgage — interest deduction alone can wipe out taxable income.
    • Significant repairs, agent fees, property management costs.
    • You can claim depreciation (Pchat) on the structure portion of value.

    Quick decision rule

    If your true net rental yield (after all expenses) divided by gross rent is below 10%, you usually win on the marginal track. Above 10%, the flat track wins. For high earners, factor in marginal rate (~47%) when computing the breakeven.

    Foreign-resident landlords

    Same three tracks, but the income tax filing is required even when below the exemption threshold (the simplified regime is not always available). Treaty considerations apply to the broader portfolio.
